I feel that AC (B) is superior to (D). Paragraph 2 states that "Dworkin's view is that..."; this snippet leads me to believe that the paragraph evaluates the theory of legal positivism (B), as opposed to just discussing the basic tenets (D).

Can someone help me understand why tenets is better?

You wrote that this is Q4, but I think you’re referring to Q22.

The real difference between the two answers you’re considering is “evaluate” (express an opinion about) vs. “identify” (neutrally describe).

Since P2 doesn’t involve the author expressing an opinion about legal positivism, but rather presenting some of its core beliefs, (D) is a more apt answer. Even the one line about Dworkin doesn’t seem to be an evaluative good/bad idea, just a description.

And if it were DWORKIN's evaluation, not the author's, then the function of that paragraph would be something like "to present one scholar's evaluation of the theory of legal positivism".
