Here are two possible solutions for this problem -- one for if you used frames, one for if you did not.

Could anyone explain why the top shelf can only have two places? The rule is it has to be less than the bottom shelf.

I found this puzzle really hard. :(

I know this won't help the original poster, but in case it could help someone else:

the top shelf can only have 2 books because if the top shelf had 3 the rest could be distributed only 1 of 2 ways without violating the 2 per shelf rule.
1. Top: 3.
Middle: 3.
Bottom:2
This would violate the bottom has more than top shelf.
2. Top: 3
Middle: 2
Bottom: 3
Which also violates the bottom has more than top shelf rule.

Essentially, if the top has more than 2 books, there won't be enough books to follow the top<bottom rule and the 2 per shelf rule.
